In Brazil, the practice of torture intertwines deeply with its own history. The literature on the subject has had a greater intensification on its registers during the Dictatorial Regime (1964 to 1985). In spite of the Brazilian Constitution of 1988, Brazil only makes efforts to investigate the crimes of torture of this period to comply with the provisions of the United Nations in 2011. The European Courts and the Security Council: Between "Dédoublement Fonctionnel" and Balancing of Values

The recent case law of various international tribunals facing questions related to UN Security Council resolutions shows the clear tendency to grant primacy to the UN legal order. This trend, far from being well founded on formal arguments, appears to be a tribute to a legal order perceived as superior, and, at the same time, is revealing of the ‘value oriented’ approach followed by the courts. The concept of ‘direct applicability’ and ‘self-executing’ nature of international norms is still object of intense debate in the international legal scholarship. In Italy, such a debate has attracted new attention in the light of a recent ruling of the Joint Sections of the Court of Cassation, according to which the norms enshrined in the European Convention of Human Rights are not directly applicable in domestic proceedings.
